Agreement to Terms

Welcome to WishVault! These Terms of Service ("Terms") govern your access to and use of the WishVault application, website, and services (collectively, the "Service").

By creating an account or using WishVault, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

Important: These Terms contain a limitation of liability and other provisions that affect your legal rights. Please read them carefully.

Eligibility

WishVault is intended for users of all ages. However:

• Users under 13 years of age must have parental consent to create an account
• Parents or guardians are responsible for monitoring their children's use of the Service
• You must provide accurate information during registration
• You must not impersonate another person or provide false information

User Accounts

Account Creation

To use WishVault, you must:

• Create an account with a valid email address
• Verify your email address
• Choose a secure password
• Provide accurate and complete information

Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Not sharing your account with others

Account Termination

You may delete your account at any time from your profile settings. Upon deletion, all your data will be permanently removed as described in our Privacy Policy.

Description of Service

WishVault provides:

• Wishlist Management: Create, edit, and manage personal wishlists with photos, links, and descriptions
• Group Features: Join up to 2 groups, each with a maximum of 100 members
• Profile Customization: Add personal preferences like sizes, favorite colors, hobbies, and birthday
• Wish Sharing: Share your wishes with group members
• Member Profiles: View profiles and wishes of other members in your groups
• Birthday Reminders: Get notified of upcoming birthdays within your groups
• Group Management: Create one group, invite members, and manage group settings

User Content and Rights

Your Content

You retain ownership of all content you create on WishVault, including:

• Wish descriptions and photos
• Profile information and avatar
• Notes and preferences

License to WishVault

By posting content on WishVault, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and store your content solely for the purpose of providing and improving the Service.

Content Responsibilities

You agree that your content will:

• Be accurate and truthful
• Not violate any third-party rights (copyright, trademark, privacy)
• Not contain malicious code or viruses
• Comply with all applicable laws
• Be appropriate for all ages (family-friendly)

Group Features and Responsibilities

Group Limits

• Each user can join a maximum of 2 groups
• Each user can create only 1 group
• Each group has a maximum of 100 members

Group Creators

As a group creator, you can:

• Name and manage your group
• Generate and share invite codes
• Remove members from your group
• Delete your group (which removes all members)

Group Members

As a group member, you agree that:

• Your wishes and profile will be visible to all group members
• You can view other members' wishes and profiles
• You can leave a group at any time (unless you're the creator)
• You will respect other members' privacy and wishes

Prohibited Activities

You may NOT:

• Use WishVault for any illegal purpose
• Harass, abuse, or harm other users
• Post inappropriate, offensive, or adult content
• Spam or send unsolicited messages
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated tools (bots) to access the Service
• Collect or harvest user data without permission
• Impersonate others or create fake accounts
• Violate any third-party intellectual property rights
• Interfere with or disrupt the Service
• Upload malware, viruses, or malicious code
• Use WishVault for commercial advertising without permission

⚠️ Violation Notice: Violations of these Terms may result in immediate account suspension or termination without warning.

Intellectual Property

Our Property

WishVault and all related trademarks, logos, and content (excluding user-generated content) are owned by WishVault. You may not use our intellectual property without written permission.

Third-Party Content

Users may post links to third-party websites and products. We do not endorse or take responsibility for third-party content. When you click external links, you leave WishVault and are subject to the terms and privacy policies of those sites.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy.

Key points:

• We never sell your personal data
• Your wishes are only visible to your group members
• We use industry-standard security measures
• You can export or delete your data at any time

Service Availability

While we strive for 99.9% uptime, WishVault is provided "as is" and "as available." We do not guarantee:

• Uninterrupted or error-free service
• Complete security against unauthorized access
• Availability during maintenance or emergencies
• Compatibility with all devices and browsers

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

Disclaimer of Warranties

WISHVAULT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHVAULT SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR GOODWILL
• SERVICE INTERRUPTIONS OR DATA LOSS
• USER-GENERATED CONTENT OR USER CONDUCT
• THIRD-PARTY WEBSITES OR PRODUCTS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.

Note: WishVault is currently a free service, so you have likely paid $0.

Indemnification

You agree to indemnify, defend, and hold harmless WishVault, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct

Termination

By You

You may terminate your account at any time by deleting it from your profile settings.

By Us

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Illegal activity
• Harassing or abusive behavior
• Security concerns
• Extended periods of inactivity

Effect of Termination

Upon termination, your right to use WishVault ceases immediately. All provisions that should survive termination (including liability limitations, indemnification, and dispute resolution) will remain in effect.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• We will notify you via email for material changes
• We may display an in-app notification
• Changes become effective immediately upon posting

Your continued use of WishVault after changes constitutes acceptance of the new Terms. If you don't agree, you must stop using the Service and delete your account.

Dispute Resolution

Informal Resolution

If you have a dispute with WishVault, please contact us first. We'll work in good faith to resolve the issue.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Jurisdiction

You agree to submit to the exclusive jurisdiction of courts located in the United States for any disputes arising from these Terms or your use of WishVault.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WishVault.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
